Scope and Content

This series is composed of the original abstracts and briefs filed by attorneys arguing cases before the Utah Supreme Court. Abstracts generally are summaries or excerpts from the records of the lower court which originally heard a case which has been subsequently appealed to the Supreme Court. Briefs are written arguments of the attorneys and generally will include the legal authorities, such as previous court decisions, laws, etc., on which the attorney is basing his argument.

Abstracts and briefs appeared to go through a three-stage process. The attorney would first prepare an abstract or brief, have it typed, and then file it. The documents might, alternatively or subsequently, be typeset and printed in a pamphlet form. Following printing, the documents may be bound together in volumes containing several cases.

There is no apparent explanation for some records being left in the typed form and some progressing to printing or ultimate binding. Abstracts and briefs from a single case may be found in typescript, unbound printed, and book-bound forms.

This series contains those documents which were left in their typescript form. Beginning with case 5529, the Court began to bind the typewritten documents into volumes without the intermediate step of printing them. These volumes are also included in this series, as they form the continuation of the typewritten files.

Documents which were typeset and printed in a pamphlet form, yet not bound in the volumes of abstracts and briefs were usually filed with the typewritten documents. Those which were filed with the typewritten documents are maintained in this series.

Gaps in Series

Not every case necessarily had briefs or abstracts filed, though we would expect that most would. Jumps in case numbers, therefore, may or may not represent actual gaps. Such jumps may also indicate that the material is in the related series.
